REFUND POLICY

Introductory Statement

Participation in Edinburg Spotlight does not constitute the purchase of a conventional service or deliverable product; it constitutes the acquisition of a curated feature placement within an independently produced documentary program. By its very nature, documentary production necessitates substantial advance commitment of resources, including but not limited to coordinated production schedules, reserved crew availability, specialized equipment deployment, and structured post-production workflows. These commitments are initiated and irreversibly set in motion immediately upon a Participant securing a Placement.

Unlike ordinary commercial services, which may be canceled or deferred with minimal systemic impact, a documentary program operates within rigid production timelines, multi-day filming frameworks, and editorial pipelines that cannot be unwound, reassigned, or replicated once a Participant has been integrated into the production matrix. As a result, all payments made to secure a Placement are deemed fully earned upon receipt and correspond to production decisions and allocations undertaken in reliance on Participant’s commitment.

Furthermore, documentary work is inherently editorial and discretionary, governed by creative judgment, narrative coherence, and platform-specific distribution strategies. Engagement with the Program does not, and cannot, guarantee appearance, prominence, promotional emphasis, particular narrative framing, or release on any specific date or platform. These attributes are intrinsic to documentary storytelling and form a material condition of participation.

In light of the foregoing, and in alignment with prevailing practices within the film, television, and documentary industries, all payments made to Producer in connection with a Placement are strictly non-refundable, as set forth in the policy that follows.

EDINBURG SPOTLIGHT — NON-REFUNDABLE PAYMENT POLICY

1. Non-Refundable Payments

1.1. All payments made to Edinburg Spotlight (“Producer”), including deposits, partial payments, full payments, or any fees associated with securing a Placement in the Program, are strictly non-refundable and non-returnable under all circumstances.

1.2. Participant acknowledges that all payments constitute consideration for the opportunity to participate in a documentary program and that such payments, once tendered, cannot be rescinded, withdrawn, or reversed for any reason.

2. Non-Refundable Deposits

2.1. Any deposit paid to secure a Placement—whether designated as a percentage of the total fee or otherwise—shall be immediately earned by Producer upon receipt and is non-refundable.

2.2. Deposits may not be transferred, credited, reassigned, or repurposed to any other date, service, or individual.

3. No Refunds for Participant Cancellation, Rescheduling, or Non-Participation

3.1. Participant cancellation, withdrawal, failure to appear, scheduling conflicts, or any inability or refusal to participate in filming shall not entitle Participant to a refund.

3.2. If Participant requests rescheduling outside Producer’s permitted windows or fails to meet scheduling obligations, Producer may—but is not required to—offer an alternative date in its sole discretion.

Such circumstances do not create eligibility for refunds, credits, or fee reductions.

3.3. Any second cancellation, whether timely or untimely, constitutes forfeiture of the Placement and all amounts paid.

4. No Refunds Based on Editorial, Narrative, or Creative Decisions

4.1. Participant understands and agrees that Producer retains full and final editorial control over all aspects of the Program.

4.2. Decisions regarding narrative structure, portrayal, footage selection, editing, sequencing, or whether Participant appears in the final version of any episode shall not provide grounds for refunds or compensation.

4.3. Producer is not obligated to include Participant in any specific episode, release schedule, or version of the Program.

5. No Refunds Based on Distribution, Release Timing, or Platform Decisions

5.1. Producer retains exclusive discretion over when, where, and whether the Program—or any portion involving Participant—is released.

5.2. Platform restrictions, release delays, non-release, or Producer’s decision to limit or disable sharing functions (including downloading, reposting, remixing, or embedding) shall not form a basis for refunds.

5.3. Public reception, commentary, or reception by viewers is outside Producer’s control and does not entitle Participant to any refund or remedy.

6. No Refunds Following Termination for Conduct

6.1. If Producer terminates Participant’s Placement due to misconduct, breach of Agreement, interference with production, non-cooperation, or any conduct deemed inappropriate by Producer, all payments are forfeited.

6.2. Termination for conduct does not create eligibility for refunds or credits.

7. Chargeback Waiver

7.1. Participant expressly waives any right to initiate chargebacks or payment disputes with any financial institution.

7.2. Any attempted chargeback constitutes a material breach of this Agreement.

7.3. Participant authorizes Producer to provide relevant documentation—including this Policy, the Terms & Conditions, payment records, and evidence of participation—to contest and reverse any attempted chargeback.

7.4. Participant shall be responsible for all fees, penalties, and administrative costs incurred by Producer in responding to such disputes.

8. No Refunds Under Any Circumstances — Comprehensive Clause

8.1. Without limiting any provision above, no circumstance—foreseen or unforeseen—shall entitle Participant to a refund, including but not limited to:

  • illness or personal emergencies

  • changes in business operations or ownership

  • dissatisfaction with portrayal or editing

  • relocation or scheduling conflicts

  • delays in release

  • changes in distribution platforms

  • changes in Participant’s financial situation

  • internal miscommunication within Participant’s organization

8.2. The non-refundable nature of all payments is a material condition of this Agreement.

9. Acknowledgment

9.1. By submitting payment, Participant affirms that they have read, understood, and agree to this Non-Refundable Payment Policy.

9.2. Participant acknowledges that no verbal or written statements outside of this Policy and the Terms & Conditions shall modify, waive, or alter the non-refundable nature of payments.
