Premium Member Access Policy

1. Purpose

Edinburg Spotlight exists to preserve, celebrate, and document the individuals, organizations, and small businesses that shape the City of Edinburg through cinematic storytelling and community-driven media production.

Premium Member Access is an optional intellectual property licensing framework designed for participants who wish to maintain Edinburg Spotlight production assets as permanent components of their business branding, marketing, or digital presence beyond the Standard Sharing Permission.

Participation in Premium Member Access does not transfer ownership of any Content produced by Edinburg Spotlight and shall only grant those rights expressly identified within an applicable Producer Agreement.

2. Definitions

For purposes of this Policy, the following definitions shall apply:

Standard Sharing Permission

Permission to share links and use native reposting tools for publicly released Edinburg Spotlight Content without charge, while retaining original attribution and the connection to the original post. This permission concerns sharing publicly released content only. It does not include a commercial license, additional materials, or review access. Any paid rights and membership benefits are defined in the applicable written agreement, with costs discussed before commitment. Existing written agreements remain in effect.

Premium Member

Any individual, business, organization, or entity that enters into a valid Premium Member Access agreement with Edinburg Spotlight.

Content

All films, video segments, photographs, graphics, promotional materials, interviews, audio recordings, edits, derivative works, and any other creative assets produced by Edinburg Spotlight.

Commercial Curation

The use of Content as a maintained business promotional asset, including downloaded or reuploaded media, pinned or prominently featured placements, permanent profile Highlights, independently hosted media, marketing materials, or advertising campaigns. An ordinary original-linked native repost is not Commercial Curation merely because it remains accessible in a repost tab or sharing history. Personal bookmarking alone is not public promotional display. Website embedding is addressed separately in the Content Sharing & Attribution Policy.

Temporary Social Sharing

Sharing publicly released Content through native social media Stories or equivalent features that expire automatically and are not retained in public Highlights, pinned, or otherwise prominently maintained as business promotional assets. Ordinary native reposts are also permitted under the Standard Sharing Permission and do not need to expire.

License Period

The duration for which authorized commercial usage rights remain active pursuant to an executed Producer Agreement or membership arrangement.

3. Production Participation and Standard Sharing

Edinburg Spotlight selects and develops documentary stories with its own creative direction. Submitting an inquiry does not guarantee selection or production. Payment covers the licensing rights and membership benefits expressly identified in the written agreement; it does not purchase ownership or creative control. Costs and the agreed scope are discussed before commitment.

For publicly released Content, participants may use the Standard Sharing Permission without charge to:

• Share links to their released documentary on Edinburg Spotlight platforms;

• Receive native tagging and attribution where applicable;

• Allow audiences to discover their business through Edinburg Spotlight's digital archive;

• Utilize standard platform resharing functions;

• Share publicly released Content through Temporary Social Sharing methods.

The Standard Sharing Permission does not authorize downloading, reuploading, editing, advertising, or maintaining Content as a pinned, highlighted, or comparable featured business promotional asset. These uses require separate written permission or an applicable license.

4. Intellectual Property Ownership

All Content created, produced, edited, or distributed by Edinburg Spotlight shall remain the sole and exclusive intellectual property of Edinburg Spotlight.

Premium Member Access does not constitute:

• A transfer of copyright ownership;

• A transfer of trademark rights;

• Joint authorship;

• Editorial ownership;

• Partnership interests;

• Co-production rights; or

• Any other proprietary claim not expressly granted in writing.

All rights not expressly granted shall remain reserved by Edinburg Spotlight.

5. Commercial Licensing Rights

Commercial Curation and other uses beyond the Standard Sharing Permission require separate written permission or an applicable commercial license through Premium Member Access or another approved arrangement. Ordinary native reposts remain permitted without charge even when accessible over time. Separate paid videos and photographs are available through membership access arrangements; documentary participation does not automatically include these assets or their usage rights.

Edinburg Spotlight may offer licensing structures that include, but are not limited to:

• Asset-specific licenses;

• Fixed-term licenses;

• Subscription-based licenses;

• Limited-use commercial licenses; and

• Other customized Producer Agreements.

The scope, duration, and permitted uses of any license shall be determined exclusively through the applicable agreement.

6. Review Access and Editorial Control

Premium Member Access does not include advance viewing or documentary review access. Those opportunities are available only through Executive Member Access, subject to its applicable written agreement. Premium Member Access does not grant:

• Editorial approval rights;

• Creative direction authority;

• Guaranteed modifications or revisions;

• Authority over release schedules;

• Authority over narrative structure, music selection, editing decisions, or artistic presentation.

Premium membership does not grant the right to preview the documentary, approve the final cut, or request edits. Any advance viewing and opportunities to request changes are governed by the applicable Executive Member Access agreement. Edinburg Spotlight retains final editorial and creative control.

7. License Expiration and Removal Requirements

Commercial usage rights granted through Premium Member Access shall remain valid only during the applicable License Period.

Upon expiration, suspension, cancellation, or termination of such rights, Members shall promptly discontinue all unauthorized commercial use of licensed Content, including any permanent digital curation that falls outside the Standard Sharing Permission.

Continued use following termination shall require a renewed or modified Producer Agreement.

8. Payment Requirements

All Premium Member privileges, licensing rights, and related permissions shall become effective only upon full satisfaction of all applicable membership terms and financial obligations.

No commercial rights shall exist unless expressly authorized by Edinburg Spotlight through an active agreement.

9. Reservation of Rights

Edinburg Spotlight expressly reserves all rights not specifically granted under this Policy or any related Producer Agreement.

Nothing within this Policy shall be interpreted as granting ownership interests, editorial authority, co-authorship rights, or permanent proprietary claims to any Content produced by Edinburg Spotlight.

10. Policy Modifications

Edinburg Spotlight reserves the right to revise, amend, modify, or update this Policy at any time.

The version published on the official Edinburg Spotlight website shall constitute the governing version for all future memberships, renewals, and licensing arrangements.
